Terms & Conditions


Effective from: 18 May 2020


This terms & conditions (“T&C”) govern the booking and/or reservation of room (“Room”) owned and/or managed by Red by Sirocco (“Hotel Owner”) along with such other add-ons products and services (“Addons”) managed by our appointed suppliers (“Supplier”) and made available by DIY Tour & Travel Sdn Bhd (“Company”, “we”, “us”, “our”) from time to time via the Book Engine on https://rev.diytourasia.com/ (“Platform”) to guests of 18 years old and above (“Guests” and each a “Guest”, “you”, “your”). For clarification, the Company does not manage or control the Hotel Owner and/or Supplier.


Before booking and/or make a reservation of the Room and/or Addons (collectively referred to as “Room Package”) from us (“Booking”), you must read carefully this T&C and all other terms and conditions and policies pertaining to the use of the Platform including but not limited to hotel policies imposed by the Hotel Owner from time to time (“Hotel Policy”), Addons policies imposed by the Supplier from time to time (“Addons Policy”), and Privacy Policy (collectively referred to as “Terms and Conditions”). By proceeding to the Booking, you agree to be bound by Terms and Conditions and any amendments to the foregoing issued by us from time to time. If you do not agree to Terms and Conditions, you are advised not to make any Booking from us and access and/or use this Platform.



1. BOOKING OF ROOM PACKAGE

Room

1.1       All Room features on our Platform are on “first come first serve” and on “as is” basis. You are advised to carefully review the description of the Room so that it meets your expectations, such as parking, extra rooms and etc. You acknowledge that all images, photographs or videos of the Room presented, displayed, and made available on Platform are for illustrative purposes only. The actual Room may vary slightly from those shown on the Platform due to reasons including without limitation any photo quality.


1.2       You are required to provide the actual and correct information as requested by the Hotel Owner for smooth booking experiences. Such information may include but not limited to medical and/or physical condition.


1.3       You understand that a confirmed Room booking is a limited license granted to you by the Hotel Owner to enter, occupy and use the Room for the duration of your stay, during which time the Hotel Owner (only where and to the extent permitted by applicable law) retains the right to re-enter the Room, in accordance with your agreement with the Hotel Owner.


1.4       You shall, at all times and during your stay, follow the instruction of the Hotel Owner and/or us in connection to the Room.


Addons

1.5       We further provide Addons in addition to the booking of the Room. Addons are including without limitation the purchase of event tickets, airport transfer services, entrance tickets to the point of attractions and such other goods and services to be provided by us from time to time.


1.6       You agree that the purchase of Addons is subjected to the applicable Addons Policy and you agree to abide by the Addons Policy at all times.



2. PAYMENT & PROMO CODE

2.1       The price of the Room can be found on the respective Room page. Such rate may include but not limited to the cleaning fee, applicable taxes and/or such other fees as determined by the Hotel Owner and/or the Company from time to time (“Total Room Rate”).


2.2       The price of the Addons can be found on the respective Addons Page. Such rate may include but not limited to the applicable taxes and/or such other fees as determined by the Supplier and/or the Company from time to time (“Total Addons Fee”).


2.3       We may also charge specific non-refundable fees including but not limited to admin fee, handling fee and/or such fee as we may deem reasonable (“Handling Fee”) in consideration for the use of the Platform or Booking. Such a fee will be notified by us.


2.4       We reserve the right to change the Handling Fees at any time and will provide adequate notice of any fee changes before they become effective. Such fee changes will not affect any bookings made prior to the effective date of the fee change.


2.5       Some banks and card issuing companies may impose fees for cross border or international transactions. If you are making a Booking using a card issued in a different country from where we are, your card issuing company may charge you a cross border or international transaction fee. In addition, some banks and card issuing companies impose fees for currency conversion. If you are making a Booking in a currency other than the currency of your credit card, your credit card company may convert the booking amount to the currency of your credit card and charge you a conversion fee. If you have any questions about these fees or the exchange rate applied to your Booking, please contact your bank or card issuing company.


2.6       You are required to confirm the Total Room Rate, Total Addons Fee, and/or Handling Fee (“Final Payable Fee”) before proceeding for payment. By continuing to payment, you agree to pay the Final Payable Fee to us for the Booking. A confirmation email in relation to your Booking (“Booking Confirmation”) will be delivered to your registered email with us in due course.


2.7       The currency displayed on the Platform is provided as a guideline only. Neither the Hotel Owner, Supplier nor we guarantee the conversion accuracy.


2.8       We may accept any promotional codes, discount codes, voucher codes, and/or such other promotional codes, which will be made available by us from time to time, that provide a discount price off (collectively “Promo Codes” or each, a “Promo Code”) for the Total Room Rate and/or the Booking. The use of Promo Codes is subject to its terms and conditions which can be found on the Platform.


2.9       The use of a Promo Code shall be subject to the following:

  1. You must fill up the applicable Promo Code prior to placing a Booking.
  2. Only one (1) Promo Code may be applied for each Booking.
  3. Any use of the same Promo Code made after a confirmed Booking and/or any use by any person will be invalid and rejected.
  4. Unless stated otherwise, Promo Codes are not valid in conjunction with other promotions or discounts.
  5. No partial redemption or discount or redemption for any other product items or redemption for other promotions with the Promo Code will be allowed.
  6. Customers shall be bound by and comply with all terms and conditions issued by us and the terms and conditions stated herein prior to the use of the Promo Code. The Promo Code is to be used by individuals only and cannot be exchanged for cash or transferable.


2.10       We reserve the right to cancel, revise or reject any discounts or promotions in relation to the Promo Code at any time without notice and without any liability or compensation whatsoever to you or any person or party. Any decision made by us in relation thereto shall be final and binding on all persons.


2.11       You confirm, undertake and agree to comply with the terms herein and in this connection, we shall have the absolute discretion to withhold or decide not to provide any discounts or promotions for any Room Package including the Promo Code to any one as it deems fit.


2.12       We shall not be liable to any one and/or be liable to offer replacement of any Promo Codes, cash or otherwise compensate any one for expired, invalid, discontinued or cancelled Promo Codes; improper use of, or inability to redeem any Promo Code; or the inability to redeem a Promo Code due to technical issues.



3. BOOKING MODIFICATIONS, CANCELLATIONS, AND REFUNDS, RESOLUTION

3.1       Subject to the Hotel Policy and/or Addons Policy (collectively “Policies”), generally, no modifications such as change of room type, number of guests, Addons and etc (“Booking Modification”) are allowed upon Booking Confirmation. However, the Company will use its best effort to modify the details of the Room Package subject to our satisfaction of the receiving written request by the Guests. You agree to pay any additional fee associated with such Booking Modification.


3.2       Subject to the Policies, generally, no cancellation and refund is allowed upon Booking Confirmation. However, the Company will use its best effort to cancel the Booking (“Booking Cancellation”) subject to our satisfaction of the receiving written request by the Guests. Nevertheless, you agree that Booking Cancellation is subject to the final approval of the Hotel Owner and/or Supplier. You hereby agree that we shall not be held liable nor responsible for any herein stated should the Hotel Owner and/or Supplier refused to Booking Cancellation


3.3       In the event that the Booking has been cancelled and subject to the Policies, a refund (wholly or partly and as required under the Policies) will be initiated by us upon confirmation from the Hotel Owner and/or Supplier. Generally, we will take 30 days to process your refund request before submitting it to the bank for the next course of action. Subject to the respective banking policy, the bank will generally take not more than 30 working days to further process the request before the amount is reflecting on your original payment account.


3.4       In the event that if a Hotel Owner and/or Supplier cancel a confirmed Booking for whatever reason, the Guest will be notified by us or the Hotel Owner and/or Supplier, and the Guests will receive a refund of the Booking which has been already been paid.


3.5       In any event, if there is any dispute arise between you and the Hotel Owner and/or Supplier in relation to the above described, we, as an independent moderator, will settle the said dispute amicably.



4. LIMITATION OF LIABILITY & DISCLAIMER

4.1       Without prejudice to what is set out in these terms, our liability is limited and excluded to the maximum extent permitted by law, such as for personal injury and death. We shall not be liable for any losses or damages, whether direct or indirect, resulting from or connected to your Booking, use of our Platform (including negligence) or use of the links on the site, including but not limited to special, incidental, punitive or consequential damages or other economic loss, even if we have been advised of the possibility of loss or damage that may occur. The only available remedy for you is the termination of the use of our Platform.


4.2       We do not provide actual and physical delivery of the Room Package. Instead, we are merely a platform provider that provides a booking platform for Hotel Owner and/or Supplier and Guests. Any communications, negotiations, agreements and/or payments are between the Hotel Owner and/or Supplier and Guests, and we shall not be held liable and responsible for any loss and/or damages arising from such events.


4.3       We are an independent body to Hotel Owner and/or Supplier and Guests, and we are not controlling or managing any of them.



5. GENERAL

5.1       The terms herein stated shall constitute the entire agreement and understanding between you and us on the subject matter thereof, and shall supersede all prior agreements, whether written or oral, between you and us concerning the subject matter there of.


5.2       We retain the right to investigate the Booking (whether or not payment has been successfully made) from time to time for any fraudulent activities and take any measures to end them as we deemed fit and appropriate. These measures may comprise, that we are at our own discretion cancel the Booking and/or withhold any fee you have paid to us.


5.3       We shall not be liable for any breach of our obligations under these Terms and Conditions where it is hindered or prevented from carrying out our obligations by any event of force majeure or cause outside our reasonable control, or by any damage caused by any of such events.


5.4       The terms herein stated shall be governed by and interpreted in accordance with the laws of Malaysia and the parties shall submit to the exclusive jurisdiction of the Malaysian courts.


5.5       You have read and understood our Privacy Policy as stated on our website. By voluntarily submitting your personal information including but not limited to your name and contact details to us, you hereby consent and accept the term of the Privacy Policy.
